Today, May 26th 2021, was the D-day for social media firms like a Facebook, Twitter, WhatsApp, Google etc to comply with the government’s new norms. The new norms were announced in February, and the companies were given 90 days to comply. So the day started out with WhatsApp challenging the new norms in Delhi High Court, calling them unconstitutional and in violation of users privacy being a fundamental right as ruled by the Supreme Court. Whatsapp is unwilling to give in to the demand of tracing the original post of demanded by the government. It says this will break the end to end encryption. Then a few hours later, the government wrote to all social media companies wanting a status update on their compliance. Experts see this communication from the government as a sign of its unwillingness to budge on today’s deadline. This was also followed up with the government issuing a 6-page press release on Whatsapp moving the Delhi High Court. It has defended its rules, especially on traceability and said other counties like UK, USA, Australia are demanding even more from the social media intermediaries. So plenty of developments, but what’s the end result? Who will blink first? Is an amicable solution possible? Immunity from being held libel from content posted by users on their platforms is the cornerstone of every social media company’s business model.
